RE: The tariff classification of electric motors from China.

Dear Ms. McMahon:

In your letter dated April 24, 2002, you requested a ruling on behalf of Lakewood Engineering on tariff classification.

The samples you provided are electric motors that will eventually be used in fans or heaters. None of the samples were gear motors. The motors had been sent to the Customs Laboratory for testing.

The motor labelled HV-18 and the motor labelled HV-18WR are single-phase, AC motors having an output greater than 74.6 W, but not exceeding than 735 W.

The applicable subheading for these products will be 8501.40.4040, Harmonized Tariff Schedule of the United States (HTS), which provides for electric motors and generators, other AC motors, single-phase, of an output exceeding 74.6 W but not exceeding 735, other. The general rate of duty will be 4 percent ad valorem.

The motor labelled HV-21T is a single-phase, AC motor having an output exceeding 37.5 W but not exceeding 74.6 W

The applicable subheading for this product will be 8501.40.2040, Harmonized Tariff Schedule of the United States (HTS), which provides for electric motors and generators, other AC motors, single phase, of an output exceeding 37.5 W but not exceeding 74.6 W, other. The general rate of duty will be 3.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
